This is the time for any citizen to comment on any items that are not listed on the agenda under “Public Hearings” but within the Planning Commission’s purview. Anyone wishing to address the Planning Commission should submit a speaker card to the Planning Secretary prior to speaking. The speakers are requested to keep their comments to five (5) minutes. The use of visual aids will be included in the time limit. Under the provisions of the Brown Act, the Planning Commission is prohibited from acting on items not listed on the agenda.

Individuals who demonstrate disruptive conduct during public meetings that prevent the legislative body from conducting its meeting in an orderly manner are guilty of a misdemeanor as stated in PC403, disrupting a public meeting, and are subject to removal from the chamber or arrest.

Project Description: A request to consider adoption of a Resolution recommending approval to the Upland City Council on the Villa Serena Specific Plan which includes the development of the western 9.12-acre portion of the 15th Street flood control basin consisting of 65 single-family residences, private community facilities, and ancillary features/improvements; modification of 11.10 acres of the 15th Street flood control basin east of the proposed residential development to retain the basin’s stormwater and flood control capacity; the extension of 15th Street from southwest corner of the project site to Campus Avenue; and development of a 0.15-acre public pocket park on 15th Street near the north end of Fernando Avenue. The project applications include:

  • General Plan Amendment No. 23-0002 to modify the General Plan Land Use Designation from Public Utilities – Flood Control (PU-FC) to Specific Plan (SP).
  • Zone Change No. 23-0002 to modify the Zoning District from Public (PB) to Specific Plan (SP).
  • Specific Plan No. 23-0002 to establish the land use regulations for site specific development standards, design guidelines, open space and public infrastructure.
  • Tentative Tract Map No. 23-0001 to subdivide one (1) parcel into 65 numbered lots and twelve (12) lettered lots, consisting of private streets and common open space and landscaping.
  • Development Plan Review No. 23-0002 to establish the site layout consistent with the development standards identified within the Specific Plan and to establish the architectural design of the proposed residential units, landscaping design, open space design and amenities.
  • Environmental Assessment Review No. 23-0003 to evaluate project impacts to the environment and review the Environmental Impact Report (EIR) and to adopt appropriate mitigation measures to ensure project compliance with the California Environmental Quality Act (CEQA).

CEQA Determination: The Draft EIR has been prepared for this project pursuant to the CEQA Guidelines. The Draft EIR determined impacts related to biological resources, noise, and tribal cultural resources would be potentially significant. The implementation of mitigation measures identified in the Draft EIR reduced these impacts to a less than significant level. Impacts related to all other environmental topics were determined to have, (1) no impact OR, (2) a less than significant impact, and did not warrant mitigation. Appeal Period: There is no appeal period, the Planning Commission’s decision is a recommendation to the City Council. 

Project Description: A request to subdivide an existing 6.8-acre parcel located on the northern portion of the “Mountain Green” shopping center to create two additional out-parcels for two new drive-thru restaurants. Parcel 1, which includes the existing anchor retail building containing Orleans Furniture, is proposed to be 5.34 acres in size. Parcel 2 will be approximately 0.8-acre and will include one drive-thru restaurant for a future tenant (still to be determined). Parcel 3 will be approximately 0.75 acre and will include a 4,270 square feet McDonald’s restaurant within the Regional Commercial (RC) General Plan Designation and Zoning District at 233 S. Mountain Ave. (APN: 1008-101-02).

CEQA Determination: This project is Categorically Exempt from the California Environmental Quality Act (CEQA) pursuant to Article 19, Section 15315, Minor Land Divisions; Section15303(c), New Construction or Conversion of Small Structures; and 15332, In-Fill Development Projects, of the CEQA Guidelines.
